1. Scope of application
The following terms and conditions apply to all orders placed via our online store. Our online store is aimed exclusively at consumers.
A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his commercial or independent professional activity
2. Contracting party, Conclusion of contract, Correction possibilities
The sales contract is concluded with MMilitaria.
Our online store only serves the presentation of our products and does not represent a binding offer to conclude a contract.
You can place our products in the shopping cart without obligation and correct your entries at any time before sending your binding order by using the correction tools provided and explained for this purpose in the order process.
By sending your order, you make a binding offer to purchase the goods contained in the shopping cart. The acceptance of your purchase offer is made by sending an order confirmation by e-mail.
Please note that we reserve the right to accept or reject your purchase offer within two working days after receipt.
3. Contract language, contract text storage
The languages available for the conclusion of the contract: German, English. These can be viewed by using the language selector in the footer menu.
Should there be any ambiguity or contradiction between the German and English versions in the interpretation of the contract or in the application of the contractual terms, the German version shall prevail, unless the parties have expressly agreed otherwise.
We store the text of the contract and send you the order data and our terms and conditions in text form. For security reasons, the text of the contract is no longer accessible via the Internet.
4. Product details
4.1. Restrictions on the sale of the products
All items offered for sale, in particular from the period between 1933-1945, shall only be used for the purposes of civic education, defense against unconstitutional endeavors, art or science, research or teaching, reporting on contemporary events or history, or similar purposes.
By placing orders for items bearing emblems of the Third Reich, the Customer undertakes to acquire these items only for the purposes specified in paragraph 1 and not to use them in any propagandistic manner, in particular within the meaning of Sections 86, 86a of the German Criminal Code (StGB).
4.2. Product details
All listed pieces are contemporary originals and unless otherwise described in a good state of preservation.
MMilitaria does not sell copies and replicas to the detriment of the collector.
All offers and descriptions are made to the best of our knowledge and belief. Offers, descriptions and verbal declarations do not assure characteristics in the sense of § 459 ff. German Civil Code (BGB).

5. Delivery conditions
The dispatch in the inland and foreign country takes place in principle with the DHL or post office. When an order is placed, the respective shipping and packaging costs will be invoiced.
The ordered goods are properly packed and insured by mmilitaria. By handing over the shipment to DHL or Post, all risks, especially accidental loss and accidental deterioration, are transferred to the buyer.
The indicated product prices are exclusive of shipping costs. The exact amount of shipping costs will be shown to you in the ordering process and depends on the type, quantity and destination of the products. Please note that shipping costs are in addition to the product prices and must be paid by you.
We deliver only by mail order. Unfortunately, it is not possible to pick up the goods yourself.
We do not deliver to packing stations.
6. Payment
In our store, the following payment methods are generally available:
The delivery takes place in principle only against prepayment
Credit card In the order process you enter your credit card details. Your card will be charged immediately after placing the order.
PayPal To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, legitimize yourself with your access data and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after placing the order. You will receive further instructions in the order process.
PayPal may offer registered PayPal customers selected according to its own criteria additional payment modalities in the customer account. However, we have no influence on the offer of these modalities; further individually offered payment modalities affect your legal relationship with PayPal. You can find more information about this in your PayPal account.
7. Retention of title
The goods remain our property until full payment.
8. Rransport damages
If goods are delivered with obvious transport damage, please complain about such defects as soon as possible to the deliverer and contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, especially your warranty rights. However, they help us to be able to assert our own claims against the carrier or the transport insurance.
9. Warranty and guarantees
9.1 Liability for defects
The statutory law on liability for defects shall apply.
9.2 Warranties and customer service
Information on any applicable additional warranties and their exact conditions can be found with the product and on special information pages in the online store.
10. Liability
For claims based on damages caused by us, our legal representatives or vicarious agents, we shall always be liable without limitation
in case of injury to life, body or health, in case of intentional or grossly negligent breach of duty, in case of warranty promises, if agreed, or if the scope of application of the Product Liability Act is opened. In the event of a breach of essential contractual obligations, the fulfillment of which is a prerequisite for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations) due to slight negligence on our part, on the part of our legal representatives or vicarious agents, liability shall be limited to the amount of the damage foreseeable at the time of the conclusion of the contract, the occurrence of which must typically be expected. Otherwise, claims for damages are excluded.
11. Cross-contractual
Should any provision of this contract be or become invalid, this shall not affect the validity of the remainder of the contract. The parties undertake to replace the invalid provision with a valid provision that comes as close as possible to the invalid provision in a legally permissible manner.
12. Place of Jurisdiction
The place of jurisdiction is in any case the district court of Singen.
13. Dispute resolution
The European Commission provides a platform for online dispute resolution (OS), which you can find at http://ec.europa.eu/consumers/odr. We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.
